An employee of our company has been off of work due to a work related injury. He has returned to work on 2 seperate occasions, but has been unable to perform his regular duties. He is a union employee and the contract states that if an employee is off for a year his employment can be terminated. My question is does the clock re-start for this one year period since he returned to duty even if just for a few days? He did return on 2 occasions. Both of them for a period of 7 days.
