    Default Use Of Ex-Spouse's Charge Account After Divorce

    Just signed up, not sure if I am doing this right. Wanted to know if I can still file a fraud charge on ex-husband. he used a charge account in 2003 that was in my name to order items for his current wife. I found out about in 2004 when I pulled my credit report. It was investigated and he admitted to the fraud. I have a police report with evidence of the fraud. I didn't have him charged at the time because I had 2 deaths in the family out of state and I didn't have time to spend in court. Can I still have him prosecuted? I told the investigator I didn't want to ahve him prosecuted then because of the deaths and I knew he would lose his job (he's a corrections officer at a prison). I live in florida.

    I tried to post earlier, but I didn't see it. So I'll try again. My ex-husband used a credit account of mine to charge things for his new wife back in 2003. I found out about it in 2004 when I pulled my credit report. I didn't have him charged due to deaths in my family out-of state. I didn't have time to go through the court with it at the time. Can I still have him prosecuted? I have all the reports and evidence. He's a corrections officer by the way. I live in Florida. Everytime I have a financial problem, it always leads back to him.

    The statute of limitations can be different depending upon the charge. But with your having opted not to prosecute this case several years ago, it is unlikely that the prosecutor will be interested in reopening the matter even if the statute of limitations has not run. If you wish, go to the police and try to re-open the case, and you'll know for certain.

    Thanks for your help. I appreciate the time. I figured that someone might respond with sucha n answer. I just wish there was something I could do because each time he gets away with something the next thing seems to be worse than the last. I am now in litigation over his committing tax fraud against me. He filed using both children on his taxes after he signed an 8332 giving up his right to use both chldren. Now they are asking me to pay the taxes for 2004 back (with interest no doubt).
