    Default Possession of Paraphernalia

    Last night I was pulled over and my car was searched, the police found two objects of paraphenalia, however they found no marijuana (there was none in the car don't worry). When the officer pulled me over he asked "is there anything illegal in the car" which I replied truthfully and told him there were two bongs in the back. I was not placed under arrest, however I recieved a possession of paraphenalia citation, and I have to call the courts in a couple of days. This is my First Offense, and I Just turned 18. Does anyone know what usually happens in this scenario? Does the fact that I was cooperative with the police play any role in my fines/probation/etc. I talked to a clerk at the court and she said that she "highly doubts" i will go to jail for this, is this true? Any advice would be greatly appreciated. Thanks!

    Sorry It was in Michigan. It was a misdemeanor. I wasn't sure what Statute meant at first, but I hope this is enough information/

    For a first offense, you may be eligible for a deferred sentence (which means that, if you successfully complete probation, you would not be convicted of the offense). If you want a more specific answer, provide the statute or ordinance citation from the ticket. If it's an ordinance, include the city name.

    Sorry it took so long to repost to this. The only thing I can find on the citation about Ordinance is a number under it. The number is 20-193. The city was Romulus, MI. In Wayne county. Today I went to the arraignment and spoke to the clerk and officer that was in the courtroom prior to the arraignment and they both advised that I should plead not guilty because I could work out a deal with the prosecutor at the pre-trail. I did plead not guilty and I have my pre-trial date is set for July 2. Was this the right thing to do? Should I have plead guilty? The judge told me if I were to plead or be found guilty I could face up to a $500 fine and up to 93 days in Jail. I just hope that I could work this out so that I would be under advisement, like some type of probation, and that I will avoid the conviction if I complete probation. Any and all help with this will be appreciated, thanks!

    Ask the prosecutor about MCL 333.7411 sentencing.
