    Question How To Start A Lawsuit

    At the age of 5 I was placed in a foster home. While in the home, my foster mother abused me, and eventually killed my 2 yr. old foster sister. It was one of the first like it in Arizona. I recently came across the article about the trial online. The Child? China Marie Davis. My Foster "Mother" Dorothy Jean Livingston. It was a very big deal back in 1993, and I will forever suffer for it. I testified at the trial, at the age of 10, and she was sentenced to life in prison. After removing me from the home, the CPS workers made a variety of mistakes, that have affected me in my life. I have no memory of my childhood besides what I was forced to remember for the trial. Now that I am older and wiser, I realize this and would like to sue CPS and/or the State of Arizona. My mom, and the main caseworker that has been working with her and I since I was the age of 7 agrees that a lot of mistakes were made and told me that I should go forward with a lawsuit. How do I go about this?

    You need to try to find a lawyer who will evaluate your case and, based upon the result of that evaluation, commence litigation on your behalf. Have you tried to find a lawyer yet?

    No, There isn't an arrest warrant out for me... Why would there be an arrest warrant out for me? I was 5. No I havent seen a lawyer yet. The information was hidden from me for a very long time, and I still don't know all of the information. I came across the article online while I was doing research about my past. If you look up the name China Marie Davis of Arizona, you'll find the article it was printed in the Arizona Republic in 1997. Anyways, I wanted to know if I had a sufficient enough case to even bring it to a lawyer.

    And it's not an arrest warrant... It's a bench warrant. You as a senior member should know the difference, and what does that have to do with this post? I just found this website and wanted to get all of the questions I had dealing with law answered. I work at a law office, but my lawyer deals with personal injury, car accidents, worker's comp, etc. So I have questions that he can't answer and I find it somewhat embarrassing to just waltz in someplace and say hey this really crappy thing happened to me when I was younger do I have a case? I'm not that blunt and before I go into a lawyer's office, I want to know that I have a case instead of being embarrassed to hear "no you don't have a case, but nice try." I think this website was formed to help eachother, not patronize them.

    A bench warrant is a form of arrest warrant.

    If you work in a law office, your boss should be able to refer you to another lawyer who handles abuse cases.

    I am aware that Mr. Bochanis can refer me to another lawyer, and he already has. But as I stated before, I don't want to waltz into another lawyer's office, especially if My Boss is referring me, without knowing how to go about starting the lawsuit...hence the title of my post "How to Start a Lawsuit." I'm trying to make it clear to you guys, but you seem to just mock and laugh at everything I say. I thought you were here to help, but obviously not. I will find other ways from now on.

    Nobody has mocked anything.

    You want the technical process? Draft a summons and complaint, file them with the court, serve the defendant, etc.?
