My little brother had a 300 doctor bill. My father was listed as the parent. My family moves, the bill never gets forwarded and goes to collections. Collections assumes I am the father. I'm Jr. not Sr. I'm a student, they never are able to find or contact me. No one knows the bill exists. Statute of limitations expires 4 years later and they report that I am a dead beat to the creditors. I check my credit, see the collections claim (credit is 100% perfect other than that) and call this place I have never heard of. They have no social, no birthday, just a name. I explain to them that I am not the parent listed on the bill and that they need to contact my father. They refuse, they also refuse to send me a copy of the bill. Then the collector explains that there is no way to fix my credit other than for me to pay them $300. If I pay them $300 then they will fix things. (the statute has expired mid you) They acknowledge that they went after the wrong person, but if I want my credit fixed I need to pay them $300. Isn't that extortion? Is this legal? The conversion was taped. The guy was a sleaze. I called back and stated that I spoke with someone who was unprofessional and they pulled the tapes then freaked out. They suddenly became very apologetic, said he was training and steps would be taken. They referred me to another dept. but I'm getting nowhere. I have been declined from 3 homes even though my credit score is still 713. I'm not even the person listed on the bill they have. Should I accuse them of extortion, wrongful character deformation, request the tapes, and get a lawyer? If they did something illegal and I say I'm going to sue them perhaps they will just fix it to get rid of me. Did they do something illegal?
