    Default Marriage to Someone Entering the Military

    My gf is considering going into the navy. She is a US Citizen and I am here on Student Visa. We want to get married before she does, but would that complicate things as far as the INS interview, etc.? How would it work and what would we need to do? Please advise.

    The USCIS will figure things out. Believe it or not, it won't be the first time a service member is married to a foreign national.

    If your fiancée joins the military, she can ask about the experiences of the many service members she meets who married foreign nationals.

    The main point of the interview is to prove to the government that your marriage is real. They assume all marriages to foreign nationals are fraudulent, and you have to prove they are real. Thats the interview and showing proof of a life together (Bills, deeds, insurance policies...)

    So that is what you need to concentrate on proving. Yes, you will have to answer the question..."You are married, but you haven't been together for 5 months (assuming a deployemnt)...." But the fact is that Real Marriages involving 2 us citizen, one of whom is in the military go through this all the time, so it should not be held against you for that reason only.

    You will just have a little bit harder time showing that proof. You want to keep all letters, email, cards, photos, as much as you can and document them so that you can prove your life together.

    The process is after you get married, your US citizen spouse will petition for your, you will petition to change your status from student visa to permanant resident based on marriage.

    Interviews to marriage depending on the State and the case, take between 15 to 30 minutes. But she must be present during the interview date. The recomendation is to file for AOS before she departs to the navy and then wait for interview date and that's it. As long as the paper work is file properly your case should be a piece of cake, for you and your wife.
