First off, I want to say that this is my very first encounter with the law. I'm a law-abiding citizen, no offenses of any kind.
While lost in Asheville (I'm from SC) with my girlfriend at the wheel, we were attacked at a gas station while turning around. I was punched a few times in the face, literally knocking me silly - not knowing what was going on and fearing for our safety, I removed my handgun from the glove box, loaded it and fired a warning shot into the air. BIG MISTAKE.
I'm now facing concealed weapon and discharge misdemeanors.
I'm seeking legal counsel and have another consult tomorrow with another lawyer.
I was refused the right to give a statement, I even pointed out the man that attacked me and so did she. The police did nothing and did not arrest him. I was not read my rights at any time during the arrest or detainment process. The cops even allowed the attacker to press "assault by pointing a gun" charges against me. Obviously a bogus charge.
Again, I'm seeking legal counsel but I was hoping I could get some input or advice from this forum about this matter. I feel as though I was violated and descriminated against in the whole process. Ultimately, I don't want to go to jail for defending myself...even though I realize my actions were a mistake.
Any thoughts to this?
