    Default H1B Issues

    I need help!!! I worked in a company in california for 1.5 years. They offered me full time last year in August. They filed my H1B. My H1B was approved in September 8th. I was asked to go to India on September 16. However, the company did not pay my salaries as defined in our H1 agreement. I filed with the department of labor. Now the company says that I was never an employee with the American Firm. Can you tell me if they have any validations to their claims, as all agreements that I signed were with the US firm. I filed my H1 here through the US firm. I would really appreciate a speedy response or any resources with regards to sections of laws that I could refer to to present my case. I appreciate your help in advance.

    Default Immigration Problems - H-1b Visa

    It would be difficult to evaluate your plight without the opportunity to review the documentation. I suggest that you have your contracts reviewed by an immigration lawyer, probably at a firm that also handles business torts. You should be able to recover any unpaid wages; unfortunately, that probably won't help you in relation to your visa.

    Default Mam, thank you for your response

    i will detail everything below.

    a) Mam, we filed for H1 on August 24th
    b) I have the receipt and I-94 dated september 6th.
    c) I have the employment letter and the H1 agreement that was filed with the INS and Department of Labor (LCA)
    d) The filing was done as a change of status. I was on F-1 earlier and then came on to an H1
    e) I left for India on the 22nd of September.

    Please do let me know if this information is sufficient. I will provide any other information that you might desire. I appreciate this assistance as I am in a financial mess now.
