    Default Fiancé Is Not The Biological Father

    I had a brief relationship with a guy and ended up getting pregnant. He really has had nothing to do with me since which is actually a blessing as he isn't a very responsible man and I want more for my child. In the meantime, I started dating a wonderful man who is so excited about this child that you'd never know he's not the biological father. We are now engaged and the baby is due in 2 weeks. My question is; can I put my fiance's name on the birth certificate as the father since he has every intention of raising this child and wanted to adopt anyway? I live in Eastern MT and will be having the baby in Western North Dakota and have no idea what the law is regarding this.

    No, you can't put your fiancé on the BC...that would be fraud. After you are married you can check into a Step-parent adoption.

    If you are married at the time the child is born, your husband would be legally presumed to be the father (Montana Code § 40-6-105) although that presumption would be subject to challenge.
