    Default Military Husband Commits Adultery

    I moved out of my husbands home April 1st 2007 and since that time we had been talking and trying to fix our marrage at least that is what he had been telling me up till May 27th 2007 when he mentioned a divorce. I found he had been cheating on me with two women that are willing to stand by me and testify to it. He filed for a divorce on June 1st 2007 on the grounds of mental cruelty I don't want to have a legal paper saying I was cruel to him when I wasn't the problem. I don't have the money to file for a divorce at this time and his lawyer is saying that he can't put cruelty or adultry on his client because the State of Illinois doesn't alow it that way. I want to know if there is any way of getting the blam off me besides waiting six months for a no fault divorce? I also want to see how and if I can file UCMJ action under artical 134 against him for adultry?

    Get a "how to handle your own divorce" book and file a counterclaim, or hire a lawyer to help you.

    You can't initiate Article 134 proceedings, as you're a civilian. If you're feeling sufficiently vindictive, you can attempt to report his conduct to military authorities who will decide if they believe there is a sufficient case to merit further action.
