i have an 11 year old son who was born out of wedlock in the state of florida. his dad & i moved to georgia when he was one. then i moved with the child to alabama/nevada.
i recently allowed him to move in with his dad temporarily while i was transitioning/moving from las vegas to new york. when i went to georgia to pick him up, there was quite a bit of resistance from his father. it took a threat of me filing charges against him for interfering with my parental rights to finally get my son and leave with him.
in the state of georgia, he would have to be "legitimated" in order to have any parental rights.
my question is: does the same hold true in the state of new york? what are my rights as the child's natural mother? can the father file any proceedings in new york when he resides in georgia?
i'm just not sure what actions i should take, if any, now that i have my son safely with me. i want a formal custody order so that we never have this kind of "drama" when my son is visiting him in the future. but i am not sure if trying to file that kind of action would negate all the legal paperwork he would be required to file in georgia.
any knowledgeable feedback would be welcomed.
