    Question Prostitution and Pimping

    I am 19 years old and in nursing school. Last week I was charged with pimping and prostitution. Is it considered pimping when you were driving and didn't fully know what was giong on until the last minute and sisn't recieve any money? And is it prositution if there was no verbal agreement on sex for money? I live in Georgia and I feel like I am completely innocent because I didn't do anything. The man that i had sex with gave me money after we had talked about me having two jobs and going to college and he said that it would help me with bills. I have an attorney and I am just wondering if any of that makes any sense to anyone else...

    From the Georgia Code:

    § 16-6-11. Pimping

    A person commits the offense of pimping when he or she performs any of the following acts:

    (1) Offers or agrees to procure a prostitute for another;

    (2) Offers or agrees to arrange a meeting of persons for the purpose of prostitution;

    (3) Directs or transports another person to a place when he or she knows or should know that the direction or transportation is for the purpose of prostitution;

    (4) Receives money or other thing of value from a prostitute, without lawful consideration, knowing it was earned in whole or in part from prostitution; or

    (5) Aids or abets, counsels, or commands another in the commission of prostitution or aids or assists in prostitution where the proceeds or profits derived therefrom are to be divided on a pro rata basis


    And,

    § 16-6-9. Prostitution

    A person commits the offense of prostitution when he or she performs or offers or consents to perform a sexual act, including but not limited to sexual intercourse or sodomy, for money or other items of value.


    Since you did not really provide any details, only you can determine if you committed a prohibited act.

    Since you did not really provide any details, only you can determine if you committed a prohibited act.

    This is the thing...I've already looked up the codes and everything. I am just wondering that since all i was doing was driving the car and didn't know what was going on until about 5 hours into the night, and didn't recieve any payment from the other parties if I am guilty of the allegations. I've talked to my attorney and he seems to think that there is no credible evidence against me but I am worried about my reputation more than anything....and another thing is I had sex but not for money...so the police inferred that I was payed because I was with the other parties and they were involved in pimping and prostitution...it just worries me.

    Listen to the advice of your attorney, and hope the state does not have a prima facie case and the matter is dropped.

    In the future, I would recommend you seriously consider your actions and your associates. Sometimes you get caught up in the actions of those around you.

    Lets see here hmmm, you were driving around for five hours and did not know that someone was having sex in the back seat?? What in the world had your mind so preoccupied? Also, How did the police ascertain that prostitution was going on in your back seat? Were you stopping and trying to flag people down? Sorry, I'm just not buying the I didn't know statement and I doubt a jury will either.
