    Default Shoplifting From Wal-Mart With A Friend

    Me and my friend - of the ages of 16 and 15, respectively - went to Wal-mart on Saturday -her mom needed to pick some stuff up since it was my friend's b-day. So, me and my friend started to walk about the store and we were looking at items and such. She found something that she wanted and was holding onto it. Then she walked over to a spot where she thought that the cameras couldn't see her and shoved it into my purse since she wasn't carrying one. She proceeded to do this with more items until she got to about $25 worth of items. I turned to her because she had been putting them in my purse and said, " I am not walking out of here with my purse, you stole it, therefore you have to carry the purse out of here." She agreed and I followed her out through the garden center. Once upon getting out, - not even 3 feet out of the door some people working for Wal-mart dressed in casual clothes stopped us and told us that we had items belonging to Wal-mart that they needed back and to follow them. My friend thrusted the purse towards them and they did not take it. They then asked for all the items and she started tearing them frantically out of the purse. They then took us back into an office in the back. They asked us who's purse it was and I said mine. They then asked who we were with and such and gave us papers and said that our parents had to come and pick us up or we will be in the hands of the cops. They finally found my friend's mom and by that time the cop was there. They tried calling my parents but with no sucession as my mom may have been at the hospital at that time. ( for a migraine lasting about 4 days straight - went to get a shot)
    They took pics of the items and us. My friend was frantically crying but I sat there without emotion. This certainly pissed off the Walmart people and the cop. The cop even said to me, " Well your friend out there is broken into tears and is really afraid. You're just sitting in here like it's nothing. I bet you've been burning down bridges left and right. " which is certainly not true as I have never done anything to get in trouble with the law and i'm a straight A student. He also threatened that if I were a few months older (17) that he would have "put the shiny little bracelets on me and hauled me off to jail - not the little kid jail, the adult jail. And that I would be red-lined". Never did I say anything belligerent or even rude to the cop or Wal-mart employees that were taking down our information. Well, unless of course asking questions is rude. Which I think one of the Walmart employee thought it was. She even commented to me, " Do you think this is funny? You act like you don't know what is going on here! Don't you know what you just did?!" I guess calmness and asking questions like if it's going to be on my record isn't going to get me anywhere. Gah. The cop asked me if I had enough money to pay for the items and I did. He said that I could do that, but it was up to the Walmart staff if they wanted to. They said no, it's went too far. So I was released to the cop. My friend's mom talked to the cop until I could ride home with her - provided that my mom called the cop once I got home. I have been banned from Walmart for the rest of my life ( but I don't remember having to sign anything saying I agreed with that. Isn't that a requisition saying that I have to agree with this?) So then I went home to my friend's house and waited for my mom to pick me up. We talked about it and I am not awaiting a court date and such. Ah yes, she called the cop but I have not talked with her about this.

    Is there anyway that I can get this not to appear on my record since I am so young? ( I know my friend is screwed because she is already red-lined (or red-flagged?? idk) for other things.)
    I need to be able to get into college somewhere and I don't want this to affect me. I know this was my choice I have taken and my choice of friends, but is there any way for me to opt out on community service and/or probation?
    I have done a little research and I have found that if you attempt to steal less than $25 worth of items they cannot press charges? Is this a rumor? If it is true, then could the said items be separated between me and my friend so that the cost would be under the allotment?
    I am not trying to get off scot-free, just trying to keep the punishment from affecting me in later years and to keep it at a minimum.
    Please, if you have any advice, don't be afraid to leave it.

    P.S. - Oh yes.. I live in the fine "show me state" of Missouri. heh.

    Is there anyway that I can get this not to appear on my record since I am so young?Consult with a criminal defense Attorney and ask about diversion programs ( I know my friend is screwed because she is already red-lined (or red-flagged?? idk) for other things.)
    I need to be able to get into college somewhere and I don't want this to affect me.The time to think about that was before the theft I know this was my choice I have taken and my choice of friends, but is there any way for me to opt out on community service and/or probation?See my first answer

    Your a minor your records should be sealed once you become an adult so this will hardly follow you the rest of your life.

    It sounds to me that there is a litte more than just your friend putting things in your purse and walking out of the store. If you did select and concealed merchandise and you exited the store and made no attempt to pay for said merchandise you did shoplift. Lucky for you that your a minor and in most states you may only have to pay civil restituion, do community service and this will never be on your record. If your friend was the only person who selected and concealed merchandise exited the store and made no attempt to pay for said merchandise you should ask her to stepup and do the right for you.
