    Default Police Did Not Arrest, But Issued A Ticket For Shoplifting

    It was my first offense.. The officer came to the store and said he would give me a citation and told me Id have to show up in court in about a month..

    I was just hired at a job and they told me I needed a background check..

    Would this show up since it wasnt an arrest... but I was given a citation.. ?

    A citation is an arrest. The only difference is, by signing the citation you promised to appear in Court - in lieu of being taken to jail and made to post bond.

    Yes you were arrested. The Loss Prevention staffed performed a "Citizens arrest" on you for theft. There was no need (PD felt) to take you to jail where yes you would be forced to post bail etc. The citation is a noptice to appear in court to face these charges. At that time you can choose to fight the charges or enter a plea. Since there is no current conviction it cannot show up on a background check. However if your employer does find out you can be terminated if your employers feels having athief on payroll an issue. Now many states have diversion programs you might want to look into. This can help you avoid a conviction on your record. Consult with a Criminal Defense Attorney and discuss your options
