    Default Must You Evict, With No Lease Agreement or Formal Payment Record

    Name of state: California

    I sublet part of my apartment (1bed and bath) temporarily for 1 month without any written agreement with the person.
    He moved in a week early than expected and paid me cash for that week. Now when i went to the bank to deposit his check for the month's rent, he put a check stop on this. I still have the stopped check in my possession.
    Can i get him evicted immediately? He never paid a rent on records and is just staying in for free.
    Is he still on a month to month lease basis (without any agreement) when he even stopped his first check payment? What are the laws on that?

    You can evict him. You can give a three day notice for nonpayment of rent.
