    I have the same problem. a neighbor has place a fence in the rear of my property a portion of which is clearly on my property by a recently performed survey. This is my third survey in ten tears because the stakes keep disappearing Is it illegal to remove them

    does anyone know if CT law allows you to remove a fence if it is placed on your property

    You need to be able to establish that it's your property. As I told you in your other thread, what will you have to show the police if your neighbor calls them and accuses you of trespassing and destroying her fence?

    I DID I obtained a third survey with markers buried three feet two of them showing where the fence encroaches on my property. I would like to remove the fence before they remove the surveying stakes which would have to be dug out.

    As you have been told, if you remove the fence, you must be able to prove in court that it was on your property.

    I am confused by different advise on different threads from the same people. I have stated that I have a recent survey which is consistant with the other two. The stakes are buried 3 feet deep and I would like to take action by removing the fence which is clearly on my property.
    In another thread the advise was different from what I was given regarding the need for further establishing boundaries
    I will quote with no intentions of offending the other party asking the question.

    A: You don't need anyone's permission to remove your fence that is on your
    property regardless of who put it there.

    I ask how is this different?

    It isn't. You have to be able to prove where the property line is.

    Moving or removing permanent survey pins is a criminal offense in most states.
