    Default I'm 16 - How Can I Get Out?

    Hello, i am currently stuck living with my father, i live in Wisconsin, and i have been trying for a while to live with my mother threw court and reasoning, currently there has been nothing we have found. I had heard that there was some kind of "petition" i could do to change custody from my father to my mother, that I and myself alone would fill out and turn in, any help on this would be greatly appreciated.

    i got a part time job, but im also in school yet, and finishing that would be nice, i was considering takeing off to my grandparents, my sister did that and got away with it, but getting a full time job wouldnt work. Anything else?

    Your parents can agree to change custody, or your mother can file a petition for a change of custody (assuming there are grounds which would support the petition) and ask a court to order a change.

    To panther-What are the consiquences of being reported as a runaway? ive ranaway before and got off free

    to Aaron- where would my mother or i find this? and what would qualify as "grounds"? and how long would this take?

    Boot Camp Juvie are two options! They arent first choice as you have already seen. By the way since you have a runaway history emancipation chances have just been reduced

    So, emancaption, explain that? is there a way i can get out without my fathers approval legally?

    Wisconsin has no general emancipation statute, but it does have this statute:
    Quote Quoting Wisconsin Statutes Section 880.04(1): Emancipation of married minors.
    Except for minors found to be incompetent, upon marriage, a minor shall no longer be a proper subject for guardianship of the person and a guardianship of the person is revoked by the marriage of a minor ward. Upon application, the court may release in whole or in part the estate of a minor ward to the ward upon the ward's marriage. Upon marriage, the guardianship of an incompetent is subject to review under s. 880.34.
    Consistent with that statute, there is case law suggesting that it is possible to emancipate through lawful marriage, or also through active duty service in the armed forces. Niesen v. Niesen, 38 Wis. 2d 599; 157 N.W.2d 660 (1968).

    I might add if your service in Armed forces or marriage ends before your 18th birthday you revert back to parental rule
