    Default Probation Officer Said No To Vacation - What To Do

    Live in Texas, daughter is on probation for a DUI that was bargained down to wreckless endangerment. Was stopped 2 weeks ago and refused the breath test, was arrested again-case pending, along with ALR and Probation hearing. Still haven't gotten a answer on how she broke probation by being arrested, she is innocent until proven guilty wright?
    Anyway her probation officer is a real pistol, and he has told her she cannot go on vacation with us this Friday. A trip that we have invested alot of money into,he said it's because she has a new case. Her new lawyer may be fired soon, he seems like he may be lazy on this situation.How can we get this done, do we go to the county?Who is the boss of the probation officer. She is not a threat to run, nothing like that.

    man, some people just don;t get it.

    her refusal to submit to a breath test justifies pulling her probation. As it is they are merely getting tough on her. It could be worse.

    there is a totally different set of rules for probationers.

    correct BUT she refused to submit. That is a totally different situation and as I said, reason enough to revoke probation.

    All I can say is I guess you either stay home or go without her. You think she is special and shouldn;t be held to the same requirements as everybody else that is in trouble?

    You don;t get let off easy (reduced charges and probation) and then slap the court system in the face and expect them to kiss your ass.

    If you want to be treated nice, you play by the rules. Your daughter wants to make her own rules. Good luck with that.

    Never said she was special, never said they had to kiss our a$$, I'm sure she will pay dearly. All I asked was is there anything that can be done, like go to the county, or his supervisor in order for her to get approval for going on a family trip.It is 1 man doing this, and not all PO are good people-just like any profession. Seems like they want family commitment to help out kids, even though she is not a kid anymore in their eyes (she's 20). This trip might be a good chance to help her focus on the big picture of life, short term,long term,setting goals etc......

    Which brings me to another question: what exactly are probation officers suppost to do?

    I ask only because all he ever did was have her sign a check in sheet at his office with standard questions relating to her probation. He never once called her place of residence (my house) to ask me or her mother how she was doing and did we have any questions. He never once called her place of employment and asked what she did there,how she was doing or anything.He never once called her community service supervisors to ask if she was on time,curtious, helpfull,attitude anything, just a sign in sheet saying she was there?

    I do realize I could have called him before you respond, but he is the one getting payed. You almost sound like you take offense to the question. Do you work in this field?

    Again all I asked was what could be done to change this vacation situation,that's all I was intrested in.

    I've seen judges require, as a term of probation, that the person on probation not be arrested - or even that they not have any encounters with the police. They can come to the probation hearing and try to convince the court that the arrest was unfair, but the arrest itself becomes a probation violation. Even if that's not the case, as jk points out, refusing a breath test would be.

    The probation officer has a supervisor. The supervisor can be expected to back up the probation officer. The sentencing court has the authority to modify probation or authorize a vacation. Don't expect that to happen, either. Your daughter's lawyer has probably already explained this. You can throw money at the situation, but it's highly unlikely that anything will change.

    It sounds like your daughter needs more "tough love" and less "enabling". Go on vacation, enjoy your vacation, and tell her all about it when you get back.
