i was recently charged with shoplifting and had a few questions i was hoping could be answered.
Me and my friend were caught shoplifting at a local mall. we had both stolen some cologne. we were 75 to 100 feet outside the store when a store employee chased us down, he asked my friend to take the cologne out of his pocket and told us to come back to the store with him.(1. Did he have the right to chase us out of the store and have us come back in to the store with him?)Yes he was conductinga citizens arrest no if store gave him that authority is in question but it was legal As we were escorted back to the store we were joined by a security guard who noticed the cologne sticking out of my pocket. we were eventually led to a back office were they asked us to empty our pockets onto the desk. After this i asked if i cold call my parents (i am a minor) they refused, after about 15 min i demand that they let me call my parents after i did this they said no and called the police.(2. Did they have the right to not let me call my parents?)Yes they did after about 20 min they final let me call my parents. even after my parents had arrived at the store they would not let me see them. We continued to wait in the back room another 25 min before the cop showed up and were still not allowed to see my parents untill after the officer had arrested me and read me my rights. I was held in the back room for over 1 and half hours before i was finally released to my parents.
3. Will this case even make it to court, since it was only a 30 dollar bottle of cologne?
4. Can they charge me as an adult? (i turn 18 in 7 months)
5. Do i have a case of false imprisonment against the store since we were held in the back room against our will?
