    Default Assault Causing Bodily Harm in Ontario

    I was assaulted the other week by an individual. He punched me right in the jaw while I was sitting down with my arms outstretched on either side of me on the back of my seat.
    From this hit, I now have a broken jaw, and it has been immobilized for 2 weeks and I am on a liquid only diet and am not able to do my regular activities.

    He is being charged with Assault causing bodily harm. When it comes to restitution I understand I can claim my medical bills and lost wages, but how do you put a price on suffering?

    I normally spend my summers cottaging, wakeboarding and a lot of other things (I am a sponsored wakeboard rider (not professional)), and this has ruined probably half my season from this happening, as well as the pain I am in from it.

    Is this something I should try and claim fully through the criminal process as I know there is something built into that for victims, or should I be looking at a civil case after the criminal case has finished?

    And how do you put a price on pain and suffering?

    If you're asking about getting compensation for suffering as criminal restitution, I don't know how Canada handles it, but I doubt that it is included. Restitution normally focuses on out-of-pocket losses.

    How do you value pain? That's very subjective. If you end up suing him in small claims court, consider suing for the jurisdictional limit of the court.
