    Default Arrest Warrant From A Probation Violation In Colorado State

    My wife and I got into a "domestic dispute" last year and I was arrested for "domestic violence". I slapped her in the face. We talked about it and tried to move past it. 5 days later she tells a family member of mine (a cousin I barely know) and my wife asks for advice. My cousin calls the police. A couple hours later I am arrested and held in jail (no bond due to it being a DV case) for 6 days waiting to see a judge. I see the judge and my wife speaks for me in the court explaining that she never wanted to press charges or to have me arrested. She only wanted advice. The restraining order against me to stay clear of my wife and daughter was dropped. I talked to the DA and was told I would have to do 48 hours of community service, 1 year of supervised probabtion, get a DV evaluation and take DV classes and pay any probation and court fees on top of that. I quit my job, knocked out the community service and got my evaluation done. The evaluator said the entire ordeal was ridiculous and that I shouldn't have to be on supervised probabtion. The evaluator spoke to my probation officer and they tried to work it out to get me on upsupervised probation. I accepted a job out of state. My probation officer let me go with permission and told me he would work on making the probation unsupervised.

    My wife and I met overseas and my daughter was born abroad. I was on a leave without pay status for one year while I was in the states. I lived and worked overseas for about 8 years. We went to the states to seek opportunities and it didn't work out. I opted to return to my job overseas because I felt it was the right thing for my family. This entire ordeal just added more stress and were desperate to feel "normal" again.

    I was just emailed by my probation officer a few days ago (this is about 6 months after the last time we spoke) stating that my upsupervised probation was not approved and that there will be a warrant issued for my arrest. I doubt they would go through the trouble to extradite me.

    My question is, since my wife is still with me and wants to help me fight this... do we have a case? Could we fight this?
