    Default Possession of Marijuana, Tobacco, Paraphernalia in Minnesota

    Hello, my name is Joe. I'm a minor in Minnesota and I recently was caught when two undercover officers searched my car. I, and one friend (Friend A), was waiting for our other friend (Friend B) to get his clothes because we were going up to Friend A's cabin the next morning. It was around 10:30 PM and took place in Henepin County.

    The Cops pulled up behind our car as we were parked next to Friend B's driveway. They came up to our car flashing their flashlights all over, obviously, and saw a pack of cigarettes in the back seat. They then asked us to step out of the car as they searched us. I had nothing in my pockets, but they did find cigarettes, a small pipe, and a small amount of marijuana in my glovebox. Friend A was found to have a small amount of marijuana, tobacco, and paraphernalia. He was handcuffed and put in the police's car (Not an actual police car, but I doubt that matters whatsoever).

    They questioned us a little, asking the obvious things, is this yours, did you know about it, yadda yadda. We had no way of getting out of it so we just told them the truth that all of it was ours and that we had consumed it earlier.

    Friend B then came out of his house with his bag and they searched that and I believe all he got cited for was paraphernalia. He may have gotten possession of small amount of marijuana as well, but he didn't get tobacco for sure.

    We were cooperative with them and told them the truth throughout the search, they called our parents to pick us up, and we left. We were told that we would receive phone calls in a few weeks about court dates.

    Now, I plan to basically say I'm guilty of everything I was convicted of. I already admitted it, I don't really plan on getting in worse trouble then I already am, since they waived a DWI charge for me being cooperative already. I'm just curious, what am I looking for in terms of sentencing? This is my first offense, I have no criminal record, and I'm generally a very good kid, good grades, no big issues in school, etc. Could I get a lesser sentence for saying that I'm a good kid and proving it? I know my brother got out of a ticket (Though it was only a traffic ticket) a few years ago for doing so.

    Are you charged in juvenile court, or as an adult?

    I don't believe I was ever told one way or the other. My best guess would be juvenile court.

    Found out that it will be Juvenile court. Because of this am I just looking at fines/community service/probation?

    Juvenile courts can lock you up as well. It's not likely in either case. But this way you get a juvenile record and, if you clean up your act, it should have much less impact on you in the future.

    You seem like a good kid. For what it's worth - from a mom - take this as a learning experience and don't ever get in trouble again.

    Appreciate the replies, hopefully this turns out as well as possible, a few fines would'nt be a big deal, and I feel that I could quite easily avoid any sentencing to being locked up for a period of time.

    When it comes to the actual court date, what should I look for? As I said, I plan on pleading guilty to what I was charged with, since the officers already waived charges for us being cooperative. Will they bring up certain things that could incriminate me further? For instance, we were in the car and I was in the driver's seat with the key in the ignition, can that be brought up at this point and seen as a DUI? Or since it was not charged at the time of the incident is it done with?
