    Default How To Terminate a Divorce Case

    Florida
    Do you know if there is a law or statue in Florida that says if no action has taken place in a divorce case in 1-year either party can file to withdraw the case? How would I go about researching to find this information and how to file? Where would I look? I tried to look in the Florida Statues online, but could not find anything.

    If there is no counter-complaint, the plaintiff should be able to dismiss the divorce complaint.

    A Counter Petition was filed in August 2005 and a Notice of Impasse was filed 1/26/2006. Nothing has taken place since then. I want to dismiss this case, which was filed in a city at a great distance from me, and file a new petition in the city in which I live. It would not be at an inconvience to my spouse since he works in this city frequently. He would only object because he wants it to be difficult for me.

    Can you tell me what the procedure would be to dismiss the case in the city it is in now?

    I don't know if you have any grounds for a dismissal absent consent from the other party. If you have not done so already, I suggest you consult a Florida divorce lawyer.
