    Default Receptionist Paid More Than Customer Service

    I've been working for Ethan Allen in NYC for 7 years now(my apologies if I'm not allowed to mentioned the company I work for). I started as receptionist. Two years later I was promoted to Customer Service, a position with a lot more responsibilities and not to mention stress. On top of that, I function as operations manager when ours is not available or on vacation.

    Currently, I am now working at two stores - one as customer service and the other as operations manager. I recently found out that a receptionist at one of the stores is being paid $4,000 more than me. I've been with the company for 7 years, her 8 years. I'm considering on resigning because I've been underpaid for the last 5 years. My question is, is there some sort of legal action I can take against this corporation?

    There is absolutely NO law that states that any one employee has to be paid the same or more than any other employee; time with the employer, job descriptions, etc. don't mean a hill of beans.

    Agree, you have no case for legal action. They do not have to pay all employees the same (even ones doing the same job) - they take many things into consideration when deciding on pay.

    Just the fact that she has been there a year longer than you is justification (if justification were needed, which it is not) for her to be paid more than you.

    Unless you have a valid and supportable reason to believe that she is paid more than you BECAUSE OF your race, religion, national origin or other group protected by law, you have no cause for legal action. And, frankly, what other employees are paid is none of your business.
