My father has been a Legal Alien of the United States since he came here in 1983. He is a citizen of Portugal. He married my mother who is an American citizen not too long after coming here.
In 2000 he was convicted of a felony in the state of Virginia. The felony was "maiming by mob" which I was told is the same as "attempt to kill." We recieved an appeal about a year and a half later (unonimous) but it was overturned by the commonwealth attorney. My father served five years in prison (which was the time he was sentenced to serve) until he was then taken into the INS' custody.
My father was deported in April of 2004. This is not a fair situation in any way for anyone who has had this happen to a family member. It is not only unfair for the people being deported, but also for the family members who have to suffer as well. My parents have four children and we were born and raised here. We no nothing about Portugal including language or culture. The U.S. is home for us.
We (meaning my mom and all of us kids who are all 21 by the way) are trying to get him re-entered into the country legally. I found some forms on the INS website, but am not sure if I should fill them out because I am not sure that they will get him back. (FORM I- 212: Application for Permission to Re-enter the U.S. after Being deported or removed)
I have herd several stories on this matter. I have herd that he can come back in ten years, twenty years, and I have herd not at all because of the fact that he was deported on the basis of a felony conviction. Which is correct? If there is a chance of him being allowed to come back? If so, how?
