    Exclamation Paying Child Support With Doubts About Paternity

    My husband's ex-wife is a living nightmare from hell. We have been together for several years. She told him that she would ruin him before we met. During that time she verbally agreed to take him off child support if he helped out whenever needed financially & physically. I told him he needs to give the money to the courts.

    She would call sometimes between pay periods for money and ask for favors at the last minute when he was at work. She would then be angered and reactivate the case. It was a nightmare experience picking up and dropping off the kids for him. She has never gotten over the past, because she shows it through inappropriate conversations that has nothing to do with the kids and sometimes dressing in skimpy night clothes.Know he owes for back child support. She has made our lives miserable while she lies about her income and lives in the suburbs.

    Question 1, he has one child 9 years old in TN and he never signed the birth certificate, he did not contest during the divorce, I was told through the courts he could seek an addendum through a court petition with a lawyer if the dna shows the child is not his is not his. Is that true?

    Question 2, if she gets pregnant and never changed her married last, can she name the baby after his last name if the boyfriend does not sign the birth certificate? Can she then add that child to the current case?

    Question 3, if she lied about income, can she be made to pay back the government through child support that she receives?

    He does want to be relieved of child support if this child is not his, He has asked her numerous times before for a blood test and she talks in front of the child, so the child may be aware of the issue. I do not think it is fair for women to force a child on a man and deny the correct father the honor and privilege of being a father, while using the child support system to legitimate immoral behavior.

    I'm not going to guess as to what might happen if he tried to delegitimize one of his children. I doubt that the person you heard the rumor from is correct, though, as he admitted paternity as part of the divorce judgment.

    They're divorced, so if she has more children there would be no presumption that they're his.

    If he wishes to modify child support, he can petition for a modification. He will not get any refund for any claimed overpayment which occurs prior to the date he files for modification.

    Unless they were still married at the time the child was concieved. There may be martial presumption in that case (depending on the state<s>) involved.

    The state is Tn and they are divorced. We have been through so much, I was just trying to think ahead, just is case the new father does not sign the birth certificate. She will probably give the child her married last name, instead of her maiden name, until she can legitimate that child.
