I was deported five years ago. all together I was in the states for 11 years- legally, but I did commited a felony and was placed on probation of 5 years and fine of 10500$. In the middle of my probation period I was picked up by INS and how was explained "I violated INS law and was a subject to deportation". I was held in INS detencion center for 4 months, at that point I thought that is all over but then from no where they realised me on "conditional parole". From 1998-2002 I was on that parole, my employment authorisation was re issued, and everything was OK, I was just reporting to INS office once a months, then after Sep 11th 2001, INS officer who was handaling my case informed me that I will have to leave "soon", so I made all arrangments and finally in March of 2002 I left the country. To me that was a volontary departure because I was free, I came to my own to the airoport etc. I was served with papers at the time of departure, and later when I read that better I saw the most imprtant thing its something like"inadmissable at anytime"- as I understand it is not time of 5 y or 10 y or 20y is AT ANY TIME. Now my question is its been 5 years since I left the country, I am a single parent of 3 USA citizen children, now because of the situation two oldest kids I left in the USA with my uncle who is USA citizen and youngest one is with me. MY oldest son now is 13years old and he is suffering from deep depression that's easily can overcome into shizohrenia do to the family slip up. He is actually acting distructive toward him self because he wants for us to be toghther, now I would love for my child to be with me but he speaks only english and bringing him to live here I would just mess his future up he will never end school here. Even that now as I see everything I would never live again in the states I need to obtain that Visa so I could be coming over twice a year to visit him, and he is coming to see me during winter and summer vacation. Please if there is something that I could do on my own with out a laywer let me know. Again I am "marked" as aggravated felon, even do that I never spend more than 24hours in jail. I am even willing to pay that fine of 8000$++ (now what's left for restetution) what ever it takes just so my kids can have some security knowing that I can come and visit them. Please don't take me wrong I would love for my family to be together but I can not destroy their future by bringing them to live in eastern europe now after they have all confort in the USA. I have my uncle who wuld send me an invitation letter and garantee that I would leave the country and also my firend who is very well situated would garantee for me as well. Just tell me what can I apply for, how to approach them in the embassy, shold I wait for my kids to come here and then with them and all papers go to embassy or should I do on my own with out them?
The thing that worries me the most is my son and his emotional situation, he is seeing a councelor in the USA and now he is coming here to see me in Jun I already arranged therapist here so he wold continue therapy. My daughter is 10y old and she is holding pretty tought, I dont know how long she will keep it like that, but in school she is great but in the house she has distructive behavoir, and the worst of everything is situation with youngest one she is 6 years old, desperate for her brother and sister, she actually lives for vacation time to see them and she speaks no english. One word my family is thorn apart and I am helpless. I am aware that I did a crime but actually what I did I received stolen property and sold it, and now we all are paying a life sentence.
So please tell me what can I do, and actually is there any hope for me to get a visa just to visit. Here I have a good job, for sometime I was active with in goverment, I have property here but my children are away and worst they have NO FATHER!! I am looking forward hearing from you soon.
