I am in the Dallas, TX area and need advise on a fence matter. I own a fence that was "professionally" installed 6 years ago. We are moving and placed a for sale sign in our yard. My neighbor now comes to us since she saw the sign to notify us that our fence is over the property line by 8". She states that she knew from the day it was installed but never had a problem with it. By this time we have (4) 30 ft tall italian cypress trees along the fence. To move the fence means to cut down these huge trees not to mention wreck-out a stone patio and kids play fort along the fence. Seems like a lot of work for 8".
The issue my neighbor has is... what happens when she tries to sell her property and it is discovered that our fence is over the line? If the new owner of her house requires the fence to be moved, would the new owner of our house be liable? Would I be liable down the road even if I don't live there anymore? Is there any statement I would need to get from the new owner of my house stating they would move the fence IF the new owner of her house had a problem with the fence? Should I wreck it all out and be done with it? Any advice?
