My daughter is 17 which is considered an adult in Texas. Her boyfriend is 16.
The police were called to my home and the boyfriend jumped out the window and was caught with marijuana in his pocket. They took him to juvenile but did nothing to my daughter. He has been in trouble with the law before and just got off of probation for assaulting his father.
He was put on house arrest, but will have to return to court within the next 60 days. The marijuana belonged to both of them, but he was caught with it.
My question is: If he tells the court that the marijuana was not his and that his girlfriend put it in his pocket, will they arrest her?She has no criminal history and this would be her first offense if this happens. Please advise.
