My question involves labor and employment law for the state of: NY. Our manager, who is part of management, is creating a new team and is asking us to join. We have voiced our concerns about this new team and said our work would be better served if we stayed with our current team who we both work in a support role for. The manager replies: If you decide to stay with the current team your workload will not be enough as it will be moved to the new team, plus there will not be enough budget to keep you on staff. So basically, go along with the switch over to the new team or be fired. Is this even legal or entirely up to the manager's discretion?
