    Default Broken Arm Not Fixed

    Almost two years ago while playing football I broke both the bones in my forearm (radius and ulna) in half. I went to the emergency room and the doctor there recommended that I got surgery. I went back home (this was an away game) and went to the doctor at my local hospital. He decided that I wouldnt get surgery and everything would be fine. He placed the bones back in place and it healed incorrectly. Not because of me but because he placed the bones wrong. I had no movement in my forearm. He said it was just muscle being tight and scar tissue inside. I went through physical therapy and nothing changed, I still couldn't move my arm. So a half a year later I went to a forearm specialist an hour and a half away. I went there and he told me that if I would have got the surgery right away my arm would have healed completely and no range of motion would have been lost. Now I have the surgery with the specialist and he "fixes" my arm. I went through months of physical therapy and I still don't have full range of motion. Am I in a situation to sue the doctor or do I not have a case?

    You didn't mention what state you live in to look up the SOL. It may be you have past the statute to even consider a law suit.

    There is a good chance that you made right decision to wait and allow the bones to heal after having them set rather than have an open reduction.
    I am sorry that your rom is limited but risk of an infection from surgery is great. If you now are going to have a surgical break and repair by a specialist you may be better off.
