    Default Compensation Subject to Premium

    My question involves workers compensation law for the state of: NM
    Is 401k Safe Harbor contribution included in compensation for premium calculation?

    Gross pay is included. No benefits and no deductions.

    The only exception is overtime. If someone make $10.00/hour their overtime would be $15.00 per hour. The work comp premium doesn't include the $5.00 per hour.
