    Default Must I Disclose an Expunged Misdemeanor to Become a Federal Nmls Registered Mlo

    My question involves a professional license in the state of: All states. Federal registry for MLO.
    The misdemeanor conviction (petit larceny) was from twenty years ago, however it was not expunged until July of this year. Since it was expunged and I am therefore restored to status Pre-charge and conviction, do I need to answer “yes” to any questions regarding convictions?

    What state was the conviction received & expunged in?

    The state is also important to answer the remaining questions.

    This is the question that appears on the MU4R:

    "(A) Have you ever been convicted of or pled guilty or nolo contendere ("no contest") in a domestic, foreign, or military court to any criminal offense involving dishonesty, breach of trust, or money laundering or agreed to enter into a pretrial diversion or similar program in connection with the prosecution of such offense(s)?"

    The answer is yes, you have been convicted. Then you explain it.

    Expunged doesn't mean that everything about the conviction never happened. There will always be some vestige of the record someplace and you can bet that the federal government will find it and want to know why you lied.

    Depends upon the specific state. Generally, expunged convictions are only hidden from public view but not the government so they must be disclosed if you applying for a government job or professional license through the government.
