Legally, it should be the same correct?

Most of the time it makes no difference, including the example you provided. There are instances where capitalization does make a difference, though most of those should be readily apparent to most people.

Yes, but with that kind of difference it could also be the same person. I have a last name that kind of works that way, but I have given up and simply style it the way the your first example is spelled, because computers just cannot seem to handle it the way that it actually is styled.

All of my investment accounts and a good deal of other stuff turns everything into all caps anyhow.

When drafting legal documents for persons in the example I gave, its best to get the capitalization right to avoid any confusion that might otherwise result. An ounce of prevention is worth a pound of cure, as the old English expression goes. A number of computer systems are inflexible in a lot of ways when it comes to input and display of data. But when drafting documents one is not restricted by those sorts of limitations.
