    Default Religious Discrimination at Work

    My question involves labor and employment law for the state of:

    Hello how is everyone here? I have a question I was discriminated against by two managers at work for my religion of being muslim. One manager would delete my time off request for fridays. The other would call me yelling Allah Akbar several times and saying his was Assma bin laden can he speak to me. Sent me inappropriate texts about my religion and made pictures of me that he cropped in my image with islamic Verse and gyro on my picture. And countless other things all which I have proof. Upper management did nothing and blew it off as him joking.

    I made eeoc charges months ago and the company decided to mediate so now next week is a meeting for mediation. With the overwhelming evidence what can I expect to walk away with from this mediation? How will I know if they are low balling me.

    Low balling you with regard to what? If you're expecting a lot of cash out fo an EEO mediation, you're going to be disappointed. Your recourse is usually for actual damages (back pay for raises you should have gotten, compensation for having to take unpaid time off on the Fridays, legal fees). While punitive damages are a possibility if you actually take this to court, they almost never come from mediations. You are encouraged to have an attorney involved.

    The best way is to hire a lawyer who is also a trained professional mediator so that you can be protected if they confuse you with any law points. It's like hitting two birds with one stone. You wont have to bear extra expenses for a lawyer and a mediator separately. The lawyer would be able to give you professional advice and further decisions can be made accordingly.

    While a lawyer may be advisable (and he may chose to advise you to forgo mediation, it is entirely voluntary), you don't hire mediators to represent your interests. Mediators are REQUIRED to be neutral with respect to the parties involved. You don't pay for the mediation on (federal) EEOC cases.
