    Default Maximum Occupancy Law

    My question involves landlord-tenant law in the State of: South Carolina. The house is located in Irmo of Richland county and is 5000+ sq feet, 5 bedrooms 4 bath. I want to rent out the 4 bedrooms but a neighbor got wind of it and freaked out saying they were going to contact the county about occupancy laws. It hadn’t occurred to me before that I wouldn’t be allowed to rent out rooms in a house I own. The neighbor mentioned a 3 non related person rule that she was going to check on with the county. I looked it up but I can’t find if it applies to my county/ neighborhood. So if this law actually applies, my husband and I count as related and are allowed to have 2 roommates?

    How about you give us a link to the law you found?

    While there are likely state laws on the issue there may well be more strict laws at the local level. You best bet would be to contact the zoning board for your local.

    A family of 10 could live comfortably in a 5 bedroom, 4 bath house. Your neighbor is full of hot air. Ignore him. I can't imagine any state or law preventing you from having 2 roommates.

    Though speaking as a former landlord, renting out part of your house is risky and stupid. When the arrangement goes south you'll be back here asking "What are my rights?"

    If the house is too big for you or you can't afford to keep it without without renting out rooms, sell it and get a smaller house.
