    Default Who Owns the Land

    My father owns a property erected on an untitled land which was surveyed in 1921. The survey document has the name of his uncle as claimant. Who has more right of ownership to the untitled property.

    Nothing you have said gives us one shred of information needed to make that determination. A claimant is just someone filing certain legal actions. It doesn't mean what he "claimed" was actually granted. Surveys don't determine things, the resultant court action would have.

    The best bet for your father would be to obtain professional help. A title search will look at any recorded records as to the ownership of the property. Unlike vehicles, land doesn't have a single "title" document. You need to go through all the historical records that apply to the property. If there is any question as to ownership, then your father would need to contact a real estate attorney to see what sort of action can clear up his alleged ownership.

    Is what you are asking is that your father owns an improvement (such as a house) on untitled property and his uncle claims that he owns the property?

    What does "owns a property" mean if he doesn't own the land on which the "property" sits? Are you saying that there's a house (or other similar structure) that your father claims to own that sits on "untitled land"? If so, what is the basis of your father's claim that he owns the "property"? What makes you say the land is "untitled"?

    Huh? What does "claimant" mean in this context? Can we safely assume that your father's uncle, who was named on this "survey document" from 1921, is no longer alive? If so, do you have any idea what became of your father's uncle's estate when he died?

    This question makes little, if any, sense. If the land is truly "untitled" (which I doubt), then it may be public land owned by the state or municipality. You're going to have to clarify the facts for anyone to have any hope of providing a useful response.
