My question involves a marriage in the state of: riverside, ca

I recently put a restraining order on my husband. He is a severe Narcissist and put a recorder in my closet, car, and possibly a camera in my bedroom.
I have nothing to hide but it was very scary and creepy. Perhaps there is something in the shower area. Anyway I found it and turned it in to the police station.
14 hours of worship music which just proves my point his paranoia. The DA will decide what they are going to do with this. And he has told people at
work he wants to kill me.

I reported both incidents to police. The judge denied by restraint. I need to court to explain more in details ect. A day ago he moved out to his mothers house after he realized I had filed a restraint on him.
My question is since he moved out do I still need to go to court? I have filed divorce papers I do not want to live in this house. I'm scared I just want to find a new place on my own. Can the judge order him stay away until I find a place or until divorce is final. Thank you for your help.

That's up to you. Do you still want the restraining order? Then you have to go to court.

Are you satisfied with him moving out and don't feel the need for anything further? Then cancel your court date.

My 2 cents worth. I suggest you continue your efforts to get a restraining order. Otherwise nothing stops him from coming back. A restraining order, at least, will get him jailed if he violates it.

That would be a restraining order and you'll still have to justify it to get it.

How did you find out what he told those people? Did they tell you? Would they be willing to testify to help you get the restraining order?

I suspect that the reason your application for a RO was denied is because you were seeking an ex parte order while you and the respondent were sharing the same living quarters. Only under urgent circumstances will a court order a spouse to vacate their living space without having an opportunity to be heard in response to such an application. In legal jingo it means due process of law.

Now that you two have separated from bed and board you should have no difficulty in obtaining a no contact order from the judge assigned to your divorce case or any other protective orders deemed appropriate.

I interpreted that to mean that you filed an application for a restraining order and that the judge denied your application, but then you wrote:

If my interpretation that the court denied your application for a restraining order is correct, then what is there for you "to go to court" for?

The judge certainly has the power to make such an order. However, if the court denied a restraining order, then it seems unlikely he/she would order this unless you present new evidence. Keep in mind that, while most of what you described might give you good reason to seek a divorce, most of it isn't illegal.

I suggest you seek to retain a local family law attorney.

Thank you for all your answers. Yes I have the police reports. The officer said recording without someones knowledge is California is a misdemeanor and he will be charged as such.
The 14 hours of worship music is what was recording from my computer and car as I listened on my computer and car. Because he is a secret porn addict for years which I just found out. He has paranoia thinking every one is like him. I just want to be left alone and have seeked helped for abused women. I will take the police reports to court. My spouse told me a few month ago if I ever find you with another man I will do a OJ on you and cut your breasts off.
I thought he was kidding but when your dealing with a Narcissist you just never know. Again thanks again for all your help.
