    Default Neighbor Blocks Sale of Property

    I own a 5.3 acre unimproved lot served by a 40' wide private road. I am the dominent tenament. The Nieghbor has been blocking the access, telling prospective buyers the lot is unbuildable and more. He has assaulted me twice now while trying to use my access. This last time I was ready to have him arrested but he apologized and began negotiations to repair the situation. I want to be kind BUT. I am owner and real estate agent in San Diego California. My question:

    This nieghbor has caused economic harm. I carry this lot and feel he has caused me at least 3 months carry and who knows in the softening of the market. How successful are cases of "intentional infliction of economic harm" and "slander"?

    Then, how successful when coupled with assault?

    good luck proving any loss.

    unless you have a client that will state he would have bought the property at $XX other than the neighbor causing this disruption, you are heading down a long road.

    Without that, how can you prove you suffered economic loss? You can speculate all you want as to the possibility of having sold the property prior but without proof, that is all it is.

    Quit screwing around with the guy. If he assaults you again, have him arrested.

    btw; the prior assault; not going to get you anywhere. Since you did not press charges then, you are going to have to argue why you didn;t to the courts. If the assault was so egregious you felt you had to involve the police, you should have done so. Since you failed to do so, a court could easily tell you it was apparently not a big enough deal to you to pursue it then so why should they do so now.

    You have said absolutely nothing what-so-ever to infer he slandered you.
