## How to Determine Legal Duty for Prior Born

My question involves a child custody case from the State of: Indiana

We are trying to calculate child support but need to determine the “legal duty for prior born”. Here’s the info for the prior born. There is only one parent. The income is \$360/week for the only parent. There are no insurance costs (Medicaid) or daycare costs.

Why do you have these words in quotation marks? What is it that you're quoting? Also, who are "we"? When I googled "legal duty for prior born," it appears to relate to a situation in which Parent A and Parent B have a child and Parent A also has a child with someone other than Parent B and the court is calculating the Parent A's support obligation to Parent B in light of Parent A's obligations with respect to the other child.

There is only one parent, the other parent has no rights and hasn’t been around since before the child was born 16 years ago. (Meaning parent A gets \$0 child Support For prior born). Parent A had a Child prior to Getting with Parent B. A &B have a child and are no longer together Now parent A and B are trying to calculate child support Together and fairly. In the child support calculations there is a “legal support for prior born” (meaning parents As prior born child) But it’s a dollar amount. Unlike the area for subsequent children (which gives you the percentage to use). Does that help

When i read the child support guidelines. This is all it says regarding the prior born and one parents income unknown.
“Obligation Worksheet.
ii. Income of a Parent Unknown: If actual income information for a parent of the prior-born child(ren) is unknown, the court should utilize the known income of the parent seeking the adjustment for the legal duty to support the prior born child(ren) and attribute zero (\$0.00) income to the other parent. In order to determine the adjustment to be applied, use the Indiana Child Support Guideline Schedules for Weekly Support Payments as the amount placed in Line 1.C., Child Support Obligation Worksheet.”

In the Indiana child support calculation that means that you include either child support you are already paying for another child in that spot, or you include legal financial obligations you have towards another child. However, in both cases you are talking about a child who was born before the child you are calculation child support for. There is another spot to put child support or legal obligations you have for children born after the one that you are calculating child support for.

Correct. My question is how to we determine that amount? We couldn’t do a child support worksheet for that child since parent A doesn’t receive any support. It is just one income

Have you looked at the actual child support guidelines? (the written ones) I remember there being instructions somewhere on how to calculate that somewhere.
