    Default Who is Responsible for a Parent's Medical Debts in Wa

    My question involves collection proceedings in the State of: Washington

    Who is responsible for a parent's medical debts in WA, when the parent has no income and depends solely from financial support from their grown children? If they are claimed as a dependent on a tax return, is the grown child responsible for their medical debts?

    Simply claiming the parent as your dependent on your federal income tax return would not make you liable for your parent's medical bills. Obviously if you sign an agreement to guarantee the medical bills you are liable for the debt based on your guarantee. Apart from that, though, it would appear that you are not liable to pay the medical bills of your parents. A little more than half the states have what are called filial responsibility laws. These are laws that impose some kind of responsibility to care for indigent or incompetent family members other than minor children. (All states have separate laws for the support of minor children.) These filial responsibility laws vary widely. However, Washington state is not among the states that has such a law.

    Everyone is responsible for his/her own medical bills. No other person is obligated in the absence of a contractual agreement to become liable for the debts of another.

    That a child claims a parent as a dependent for income tax purposes is of no relevance to liability for medical debt.
