In the rear of my property is a retaining wall. Per the survey, this retaining wall is located within a 5 foot city owned utility easement. The retaining wall is currently failing and needs repair. The retaining wall was installed approximately 30 years ago, likely during the construction of the neighborhood. Also, our neighbors have fences that encroach into this easement and have been notified by the city that they retain the right to remove the fence at any time. Would I be responsible for the repairs, or would the city?
