    Default Are My Reasons for Divorcing My Parents Good Enough

    Hi my name is Rainey, I am 17 years old and am looking to get emancipated. I have a job, about $1500 in savings, a job lined up in my new city and an apartment there. I'm not currently living in my own but I don't live with my parents either. So here are my questions, if I run away from home can I file for emancipation after 30 days? If I go through the court to file for emancipation what are "good enough" reasons? So far this is what I have, I do not live with my mother though she is my legal guardian, my mother does not have a room let alone a bed for me to sleep in when I'm there. I feel like my mother is verbally abusive, she constantly degrades me when I see her, tells me I need to loose some weight, that I'm a disrespectful brat, etc. My mother is not my sole supporter, she does not pay for my food, housing, or clothes. It was not until March that she brought me a bag of hand me downs that did not fit me. She and I have different ideas of my future, she wants me to go back to private school. But when I was there I was depressed and at times suicidal, I was able to get counseling but she forbade medication. I want to go to a public vo tech school where I could study a trade, a trade that I want a career in after high school. Are these good enough reasons? If they are not what are?

    One of them indicated you are in Pennsylvania.

    Now tell us on what date will you become 18 years of age.

    And answer the following:

    An important of emancipation is that you demonstrate that you are able to support yourself without the assistance of others. You are not living on your own which implies that you are dependent on somebody for lodging.

    Who is that somebody and what is the arrangement? Do you pay rent? Or are you just couch surfing.

    Where do you work? What do you do? Full time? Part time? What is your weekly take-home pay?

    What do you mean "if"? You've written that you don't live with your parents, implying that you have already run away from home. Clarify that please.

    According to a couple of appellate case decisions PA courts look at a variety of factors in determining whether a minor is emancipated and looks at each case on its own merits. There is no particular statute defining those factors.

    There are two ways of being emancipated. Emancipation by doing and emancipation by court order.

    Emancipation by doing means that you are already emancipated if you are not dependent on anybody for any support or assistance, you have a job, you are making a living, you are paying your own way for food, shelter and clothing.

    Emancipation by court order means that you have been legally relieved of what is called the "disability of minority." A minor cannot be held responsible for any contractual agreement made by the minor. That means that businesses, banks, landlords, etc will not risk entering into any contracts with minors, hence the word "disability." Your inability to contract is your handicap.

    For a judge to remove that disability you'll have to demonstrate that you are emancipated by doing.

    Now you get to explain how you are emancipated. What are you doing that an emancipated person (also known as an adult) does?

    There is no statewide statute for the emancipation of a minor in PA. Some, but by no means all, counties will deign to emancipate, or at least look the other way, if the minor is already living on their own and managing all their own financial affairs.

    But no, the reasons you give are not valid reasons for emancipation. About the only reason I've ever heard of that was, is "My parents were both killed in a plane crash and I need legal emancipation so that I can pay the rent and get the light bill transferred into my name and take care of my eleven year old brother". And even that might not be enough if Grandma and Grandpa, or Uncle Will and Aunt Susan, are standing by ready to take over.

    You see, the purpose of emancipation for minors, in those states where it exists, is not to allow them to leave home, or a bad environment. The purpose of emancipation is to provide legal protections to those minors who, for reasons outside their own control, find themselves living on their own.
