    Question Immigration Issues Due To A DUI

    Hi
    I was held up because of DUI in Iowa state. My hearing hasnt been done yet.
    I was caught because the headlights of my car were not on. My BAC was .096 and this is my very first offense or misdememanor of any kind.

    should i try to contest the case, because this conviction may have problems with my getting h1b visa next year. at present i am on OPT (optional practical training). i can also ask for deferred judgement.

    do u think my H1b processing wold be affected because of this, and can i do anything to minimize the effects.

    It's possible that this would affect your immigration - any criminal activity has that potential - but I suspect it would fall under the petty offense exception and thus not prevent your visa. I suggest you get help from a criminal defense lawyer who is familiar with immigration law, to try to resolve the charge in a manner that minimizes the potential impact on your immigration eligibility.
