I am from Texas. I resigned from my position on April 26th I was over payed for commisions in March and they were going to fire me due to me not having paperwork to back it up. I explained that my actions were not intentional and infact the only reason I had no paper work was because the offices had flooded. The following week May 4th was pay day I was due a commision check and my salary check. I recieved neither the next day I recieved a letter stating that the investigation they were performing would come to a close on May 18th and at that time we would discuss repayment options, until then they were withholding my paycheck. First off after working there for 4 years I have seen numerous people get fired for intentionally stealing and they were never asked to repay or give back. After looking on the Texas Workforce Website I have found that they cannot with hold my paycheck even if they find I owe them money. Today is the 18th still no paycheck when I called I was told they would be sending me a letter in the mail and that I owed them $3200. My commision check would more than cover this and they by law are required to release my checks, Right? What are my rights? Do I have to repay? Can they hold my checks? Please help!
