    Default Car Towed, Expired Tag (but Only the Tag)

    I live in Las Vegas, where it is legal to tow a vehicle if the registration is out of date. My registration is not out of date, just the tag (I haven’t received the updated tag from my state yes). If the tow company ran my plates they would see it is not out of date, but they still want to charge me 300 dollars. Is this legal?

    Tow companies can do law enforcement without the authorization of the police?

    Tow companies are the sleaziest companies out there.

    From where was your car towed?

    Tow companies don't "run plates" typically nor are they obliged to.

    From my apartments parking lot. I think that’s kind of bs, I shouldn’t have to pay for a tow fee if my car is legally registered. The police would consider my car in ‘driving me standard I’m surprised that a tow company would be allowed to not run plates to cross check.

    I would be surprised if registration laws regarding tows are in effect on private property such as an apartment complex, and more surprised if they could be enforced by a private entity without the city's intervention. Are you sure it was not towed by the complex for violation of some CC&Rs? Perhaps all vehicles on the property must show proof of current registration (i.e. the out of date tag).

    Have you asked the tow company for any paperwork regarding the tow?

    You're supposed to have your tag on the car, else how would anybody know that the registration is current. The towing companies tow at the order of the apartment management. Very common and they did nothing wrong to you. You should have gotten to your registration renewal early enough to get it on the car before the tag expired.

    And IF you had properly and in a timely manner updated your tags, this wouldn't have happened. Failure to display current registration tags is a violation in and of itself, and you have only yourself to blame.

    The DMV, the IRS and the County Assessor's Office uses the US Postal System. They understand and allow for the delays in delivery associated with the mail system. That is why they look at the postal date for qualification of payment. A registration mailed and post marked the last day of the month is a valid payment and is credited to be valid for the first day of the next month. It is because of the mail and clerical delays that we do not get our tags immediately. It is a delivery system the DMV agrees to use. Also, I have never heard the DMV or the police tell anyone that one must park their car on private property until the DMV and the US Postal system gets around to mailing your tags.

    Getting a citation within the first two weeks of expired tags is a BS citation and is easily dismissed at the front counter of the courthouse. No judge needed to dismiss that one. I know this because I have done it.

    The doom, gloom and finger pointing of these posts is sad.

    To the OP,
    This is what I would do. I would walk up to an officer or call your local PD and ask him this: "If I e-paid or mailed my registration on the 30th of the month, can I continue to drive my car with proof of valid registration in my possession?" If he answers "yes" then ask him if this is law or a courtesy? If it is law then your HOA must abide by that law that allows cars to be driven with legal registration. Therefore any CC&R violation would not be valid because CC&R's cannot supersede state laws.

    None of that crap matters. If the complex says you need to display current tags, authorizes the tow, and the tower complies with the other requirements, you are liable for the two charges. The fact that you "meant to" display the tabs is irrelevant. If the rules say you have to display the tabs, the fact you had a valid tag is irrrelevant. Nevada ain't California. The tow rules are less strict. As long as the complex authorized the tow in blanket terms, it's on you.

    I disagree. I could beat this one any day of the week, and I've done it before. You're dealing with a corrupt tow company and an ignorant HOA. I've beaten both of those entities...my HOA as recently as two weeks ago.

    Why do they want to see current tags? To know if you are registered, right? Well, tags do not prove that, so their vetting system is flawed and may not be supported by state law.

    I often wonder why folks here are so fast to throw in the towel. Is it because they are not good debaters, or because they like to see people fry? Not everybody is a dishrag.
