A citation could be issued for a violation of VC ß22108 which states:
Any signal of intention to turn right or left shall be given continuously during the last 100 feet traveled by the vehicle before turning.
However, your question makes no sense. What is this "phone recording" prove? Does this recording identify the driver as well as the violation? Why would the citing officer make a "phone recording" of the violation?
Keep in mind that there is a big difference between a police officer making an arrest and a citizen making a citizen's arrest pursuant to PC ß837.
When he testifies in court how is he going to identify the driver? Moving violations in California are given to the driver NOT the registered owner.
