    Question Vandalism the Hard-To-Remove Parking Violation Stickers

    My question involves criminal law for the state of: California

    Is the placement of hard-to-remove parking violation stickers on cars vandalism?
    If it is vandalism, is there an exemption for those who use these stickers on a car which is in violation of parking rules? (see the first video below).

    WHO placed the sticker on your car? Was it placed on the window? if not, then where?

    Or, perhaps, Lizard is asking because he/she wants to slap these kinds of stickers on one or more cars and wants to know how much trouble he/she might be in for doing it.

    Posting the videos suggests that you actually watched them. The video that occurred in Phoenix actually answers both your questions. Other cities and states may have different answers.

    So you're saying it is vandalism if there was no parking violation, but it is not vandalism if there is a parking violation. Am I reading you correctly?

    Then it's not vandalism because, by living in an HOA, you agree to all that stuff when you buy the home. The CC&Rs and bylaws are your contracts with the HOA that you are bound to (even if you happen to be a tenant) and you have to live by any rules passed by the board, including having stickers put on your car when you break the parking rules.

    Would you rather your car got towed?

    That's what I took away from the Phoenix video. The lot owner was justified in placing the stickers on cars that weren't paid for.

    HOA management is also justified in placing them on cars for non-compliance with the parking rules.

    As for the error in placing one on a car that was paid for, there's the practical side and there's the letter of the law. Using California as an example, the statute requires that the act be malicious to be punishable as vandalism:

    I don't see making a mistake as being malicious.

    On the practical side I seriously doubt that police will do anything about a car owner's few minutes of inconvenience. Likely will call it a civil matter. Besides, a scraper and a little Goof Off remover easily takes care of the glue residue.

    In short, if you are miffed because your car got a sticker, get over it.

    I've found the Windex wipes to be effective at removing paper stickers.
