    Default Moonlighting Issue

    This question is in regards to a quasi-federal railroad agency.

    The corporation has a moonlighting policy that allows you to work a second job, so long as it isn't a conflict of interest or in the transportation industry. All "crafts" are allowed to work their expertise on the side (IE Electricians, Carpenters, etc), with the exception of the police "craft". The police "craft" has a restriction that employees can not work secondary police or security jobs.

    Furthermore, the corporation allows all other "crafts" to hold jobs as police and security, with a confirmed case of conductor holding a poloce job.

    My question is if this seemingly disparate discrimination is legal.

    I don't see anything illegal about it. It's about what each department's union negotiated into their collective bargaining agreements.

    Agreed. What "craft" or position you hold is not a protected category under the law, meaning that it's quite legal to treat them differently.

    They don't have to allow you to moonlight, PERIOD. I have no idea what "quasi-federal" agency you're talking about, but they are most likely only limited to what they set as their own policy. If they say that they don't want their police moonlighting as police or security, that's within their rights. There's NOTHING wrong in private or government to treat employees in different jobs differently. Discrimination restrictions only apply to certain protected classes (race, religion, sex, etc...).
