    Default Can I Pay My Own Medical Costs With The Settlement

    Hi Im from California..when I get my settlement I realize my lawyer takes his percentage. After that Can I pay my own medical costs with the rest of the portion? Or does it have to be my Lawyer who pays my doctors ect.....
    Some of the medical was paid thru my own insurance which I pay for thru my employer ....why would I have to pay my own insurance twice when they got paid already? I just want are my rights as far being allowed to pay my own medical costs. Thank you so much

    Your health insurance company will seek reimbursement for any money they paid to your healthcare provider.

    If the doctors have liens on your personal injury claim through your lawyer, as may be the case if you need treatment that insurance won't cover, those bills will be paid from the settlement.

    In terms of an insurance lien, or other lien against the settlement, if the lien has been formalized through the court it will have to be paid as part of the distribution of the settlement. If it's a Medicare or Medicaid lien, even if not formalized, the lawyer risks being held personally liable if the lien isn't paid.

    Often it is best to have the lawyer pay the lien, as lawyers are often able to negotiate reductions in the amount of the lien. It's harder for an individual to do that, both because they have less experience negotiating for reductions and because insurance companies tend to offer less when they are dealing with individuals as opposed to their lawyers.
